This paper deals with the recent reform of criminal justice system introduced by Law no 103 of 23 June 2017 (also known as Riforma Orlando). Following on a constitutional perspective, the paper firstly points to procedural issues involved in the exercise of legislative delegation − that as a result of a institu-tional situation faces a sizeable obstacles for the final approval of implementing decree the Law No. 103 of 23 June 2017 –. Secondly, the article offers some reflections on the impact of this combination of political and procedural factors on the form of government.
